Resene giveaway terms and conditions

Acceptance of these terms & conditions: Resene giveaway (Giveaway) is run by Trade Me Limited (Trade Me, we, us) under the brand homes.co.nz (which is operated by Trade Me’s subsidiary PropertyNZ Limited). By entering into the Giveaway, you agree to be bound by these terms and conditions. If you do not agree to these terms and conditions, you may not enter the Giveaway and you are not eligible to redeem the Prize. Trade Me reserves the right to vary, suspend or terminate these terms and conditions, the Giveaway or the Prize at any time, without notice to you.

1. Eligibility: Entry is only open to New Zealand residents who: (i) are 18 years and over; and (ii) own a residential property in Aotearoa; and (iii) are registered with homes.co.nz; and (iv) have not opted out of receiving communications from homes.co.nz. Directors and staff of Trade Me, its related bodies corporate and any agencies or companies.
2. Giveaway period: The Giveaway closes on 15 Sep 2024 at 11:59pm (NZST) (Closing Time).
3. How to enter: To enter you must claim/track your home on homes.co.nz before the Closing Time (an Entry). When you claim/track your home or if you have claimed/tracked your home in the past, you will automatically be entered in the draw unless you selected the ‘unsubscribe’ option on electronic messages related to the Giveaway. If you own multiple homes, a claim on each of those homes will constitute a separate Entry. You must be the owner of the home claimed/tracked as at the Closing Time in order to gain a valid Entry into the draw (so if you claim a home that you do not own or if you claimed a home in the past but no longer own it, your Entry will not be accepted). We might ask for evidence of ownership before accepting your Entry or determining the Winner. Only one Entry per home is permitted, so if you own your home together with one or more other people, only one of you can claim/track your home and gain an Entry into the draw.
4. Emails and electronic communications: By entering the Giveaway you agree and consent to us sending you electronic messages, including emails, related to the Giveaway. Emails will have an ‘unsubscribe’ option where required by the Unsolicited Electronic Messages Act 2007.
5. Prize: There will be one winner (Winner). The Winner will receive a $5,000 Resene ColorShop voucher and NZD$5,000 cash to spend on what they choose (Prize). To claim the Prize the Winner may be required to provide Trade Me with additional information such as: (i) a copy of their ID; (ii) satisfactory evidence of ownership of the home claimed/tracked; (iii) evidence of their bank account number; and (iv) evidence of their address. The $5,000 Resene Colorshop voucher will be sent by post to the address provided by the Winner and the NZD$5,000 cash will be deposited into the bank account nominated by the Winner. Resene’s terms and conditions available at https://shop.resene.co.nz/terms-conditions, apply to the receipt and use of the Resene Colorshop voucher. Trade Me is not involved in the provision of any goods or services by Resene.

Winner notification and announcement: Trade Me will select a Winner from all eligible Entries using a random selection tool, and will notify the Winner by sending them an email to the email address linked to their homes.co.nz account by 18 Sep 2024. Trade Me reserves the right to select another winner (and the initial winner forfeits the Prize) if the initial winner: (i) does not respond within 5 working days of notification; and/or (ii) does not provide satisfactory evidence of ownership of the home claimed/tracked or any other information requested, within 5 working days of notification.
7. Publicity: Entrants agree that if they are the Winner their name and a description of the Prize may be published on Trade Me and homes.co.nz social media, within email marketing and/or on Trade Me’s websites.
8. Liability: To the fullest extent permitted by law, Trade Me shall not be responsible for any loss, damage or injury whatsoever arising in connection with the Giveaway (including but not limited to any direct, indirect, consequential, special, punitive or incidental loss or damages). Trade Me’s liability to any entrant, Winner or third Party will be limited in any circumstances to a maximum for all claims up to $500.
9. Privacy Act: Trade Me will collect and hold personal information such as name and email address in order to notify you if you win, and your bank account details and postal address if you are the Winner, in accordance with our Privacy Policy and in accordance with Privacy Act 2020.

11. Trade Me’s decisions regarding all matters relating to the Giveaway, including Trade Me’s decision regarding the Winner, is final and no correspondence will be entered into.
    • (a) The Winner will be solely responsible for any tax or other costs associated with the Prize.
    • (b) The Prize cannot be changed, transferred, or assigned. 
    • (c) Trade Me may verify the eligibility of entrants, and reserve the right to disqualify any Entry or refuse to award the Prize where we believe an entrant does not own the home claimed/tracked, is in breach of these terms and conditions or has been fraudulent or dishonest.
    • (d) The homes.co.nz terms and conditions (as amended from time to time) apply with all necessary modifications to the Giveaway and apply to your use of the homes.co.nz website.
